This is an application, filed under Section 438 of the Cr. PC. seeking pre-arrest bail of the accused-petitioners, namely, 1. Mr. Sanjib Sarkar and 2. Mr. Sanjib Jha, in connection with Lumding PS Case No.
199/2020 registered under Sections 341/294/325/379/506 of the IPC. Learned Additional Public Prosecutor submits that charge-sheet being CS No. 124/2020, dated 31. 10. 2020 has already been laid by the Investigating Police Officer. That being so, the petitioner, if so advised, be directed to approach the learned court below with an appropriate application for bail within 15 (fifteen) days from today, which the learned court below shall consider on its own merit. Interim order passed earlier on 21. 10. 2020 stands extended for another 15 days from today. However, if the petitioners do not appear before the learned court below within the time stipulated above, the interim order granted earlier shall automatically stand vacated.
