For the Respondent(s) : None. 04. 12. 2024 Order This present appeal has been filed against the Order dated 31. 05. 2024 passed in WP(C) No. 248 of 2024 by the coordinate Bench of this Court. 2. Today the matter came up in the motion stage, heard Mr. K. De, learned Addl G. A. appearing for the State. 3. Having perused the record, this Court prima facie finds that the impugned order that was under challenge in the present Writ Petition i. e. WP(C) No. 248 of 2024 is of the year 2011. The Writ Petition was filed in year 2024 and the matter was decided in year 2024 itself.
As such, without expressing any opinion on the merits of the case or the order, it would be just and proper to modify the order passed by the learned Single Judge in the following terms:- 4. The respondent-State shall consider the petitioner's case by providing a reasonable opportunity for a personal hearing. The concerned officials shall also issue a notice to the petitioner and inspect the premises, and, after negotiations, pass a reasoned order in accordance with the law. 5. With the above, the order passed by the learned Single Judge dated 31. 05. 2024 is modified. Till a decision is taken by the respondent-State, no adverse action shall be initiated against the petitioners’ property. 6. As a sequel, stay if any stands vacated.
