According to the learned counsel for the petitioner, order dated 28. 01. 2023 passed by respondent No. 2 herein has been thrown challenge to, which order came to be passed in an application filed by the respondent No. 1 herein under the provisions of Payment of Wages Act, 1936. 2. Learned counsel for the petitioner submits that the said application filed by respondent No. 1 before respondent No. 2 has been sought to be withdrawn by laying a motion by respondent No. 1 before respondent No. 2. However, on account of pendency of the instant petition and in terms of order passed by this Court on 31. 03.
2023, the said withdrawal application is not being proceeded by respondent No. 2 herein. 3. Thus, learned counsel for the petitioner would pray for withdrawal of the instant petition in order to enable respondent No. 2 herein to pass 2 CM(M) No. 45/2023 orders for withdrawal of the application filed by respondent No. 1 herein. 4. The submission of the counsel for the petitioner is taken on record. 5. Petition is accordingly dismissed as withdrawn. 6. Interim direction, if any, shall stand vacated.
