Pramod S/o Raju Ram Alias Rajendra, Aged About 23 Years, R/o 23 Bb Bera, Tehsil Padampur, District Sri Ganganagar. (At Present Lodged In Sub Dist. Jail, Srikaranpur) ----Petitioners Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. K. S. Oad For Respondent(s) : Mr. Hanuman Prajapati, PP HON'BLE MR. JUSTICE BALJINDER SINGH SANDHU Order 04/08/2026 Heard learned counsel for the parties, and perused the material available on record. The petitioners have been arrested in connection with FIR No.
0123/2026 of Police Station Padampur, District Ganga Nagar for the offences punishable under Sections 331(6), 331(7), 115(2), 126(2), 117(2) and 3(5) of BNS. He has preferred this bail application under Section 483 of BNSS. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case and the offences pressed against them are triable by Magistrate. The [2026:RJ-JP:36535] (2 of 2) [CRLMB-9530/2026] petitioners are in judicial custody since 06. 06. 2026. It is also submitted that conclusion of the trial of the case will take considerable amount of time. Per contra, learned Public Prosecutor has vehemently opposed the bail application. This Court has considered the arguments raised by learned counsel for the petitioners. The offences pressed against the petitioners are triable by Magistrate. The petitioners are in judicial custody since 06. 06. 2026.
Hence, keeping in view of the fact that conclusion of the trial of the case is likely to take time and the prosecution has not shown any apprehension of the petitioners fleeing away from justice, in case they are enlarged on bail and without expressing any opinion on the merits of the case, this Court deems it just and proper to grant bail to the petitioners under Section 483 of BNSS. Accordingly, this bail application filed under Section 483 of BNSS is allowed and it is directed that petitioners –Raju Ram Alias Rajendra Kumar S/o Lekhram and Pramod S/o Raju Ram Alias Rajendra shall be released on bail in connection with aforesaid FIR, if not wanted in any other case, provided each of them execute a personal bond in the sum of Rs. 50,000/- with two sound and solvent sureties of Rs. 25,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
