32256 of 2024 THIS WRIT PETITION IS FILED UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECTING THE RESPONDENT TO TAKE IMMEDIATE AND EFFECTIVE STEPS TO CONSTITUTE THE GRIEVANCE REDRESSAL AUTHORITY AS MANDATED UNDER SECTION 368 OF THE BRUHAT BENGALURU MAHANAGARA PALIKE ACT, 2020. THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA and HON'BLE MR JUSTICE K. V. ARAVIND ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA) This petition is filed by one S. Gowrishankar who appeared as party-in-person . 2. Heard learned party-in-person as well as learned Additional Government Advocate Smt. Niloufer Akbar who appeared upon service of copy of the petition in advance. 3.
The limited grievance raised and the cause sought to be espoused by the petitioner in this petition is that under Section 368 of the Bruhat Bengaluru Mahanagara Palike Act, 2020, there exists a provision whereby the Government is empowered to constitute for the Corporation the Grievance Redressal Authority consisting of the members indicated in the Section, which is not done. - 3 - WP No. 32256 of 2024 3. 1 It is the case of the petitioner that the Grievance Redressal Authority has not been constituted despite the aforesaid provision in the statute. It is submitted that if the Grievance Redressal Authority is formed and it functions to deal with the various issues, several of the civic problems and complaints arising in the city of Bengaluru would be properly redressed to the satisfaction of the public at large. 4.
While noticing the case of the petitioner, it could also be seen that the petitioner has already approached the Additional Chief Secretary to Government, Urban Development Department, by writing a letter/making representation dated 27. 09. 2024. The letter spells out the grounds as to why the petitioner wants to get the Grievance Redressal Authority constituted under the Act. 5. The said representation requesting for constitution of Grievance Redressal Authority is already pending with the said authority for appropriate decision. 6. In the above circumstances, the Court deems it appropriate to direct the competent authority-respondent No. 1 to consider the said representation in accordance with law so to decide the same expeditiously. - 4 - WP No. 32256 of 2024 7. With the aforesaid observations and without going into on expressing anything on merits, the present public interest petition is disposed of. Sd/- (N. V. ANJARIA) CHIEF JUSTICE Sd/- (K. V.
