Serial No. 01 Regular List HIGH COURT OF MEGHALAYA AT SHILLONG Cont. Cas(C) No. 32 of 2023 Date of Decision: 18. 07. 2024 1. Shri Kaind S. Marak 2. Shri Constantine T. Sangma 3. Shri Michael S. Marak, 4. Shri Bainsten G. Momin 5. Smti Mejna A. Sangma 6. Shri Backston N. Sangma 7. Shri Tengrak A. Sangma … Petitioner(s) - Versus - 1. Shri Apriline R. Marak, Chairman of Baghmara Municipal Board, South Garo Hills, Meghalaya 2. Smti Shelly Ch. Momin, CEO (Chief Executive Officer) BMB, Baghmara Municipal Board, South Garo Hills District, Meghalaya … Respondent(s) Coram: Hon’ble Mr. Justice H. S. Thangkhiew, Judge Appearance: For the Petitioner(s) : Mr. P. T. Sangma, Adv. For the Respondent(s) : Mr. S. Deb, Adv. i) Whether approved for reporting in Yes/No Law journals etc. : ii) Whether approved for publication in press: Yes/No JUDGMENT AND ORDER (ORAL) 1. The instant contempt application has been filed, alleging non-compliance of the order dated 04. 08. 2023. 2. Mr. P. T.
Sangma, learned counsel for the petitioner submits that the respondents have committed contempt, inasmuch as, after 04. 08. 2023, no payment has been made, whatsoever. 3. Mr. S. Deb, learned counsel appearing for the respondents Nos. 1 & 2, has drawn the attention of this Court to the affidavit filed on behalf of the said respondents, wherein at Annexure-3 series, it is noted that the writ petitioner, whose name appears at Sl. No. 3, had received payment on 01. 02. 2024, and thereafter again on two other dates. He submits that the allegation of violation of the Court’s orders is misplaced, inasmuch as, the respondents are doing their utmost best to pay the arrears salaries of the petitioners. 4. This Court has noted the submissions and also perused the statements of payments as annexed. It is seen that though the payments were made on 01. 02. 2024, the amounts relate to the arrears salaries, which are pending from the year 2022. 5.
In this view of the matter, though the arrears salaries are still pending, as there is no willful violation of the orders of this Court, the contempt stands closed and is accordingly disposed of.
