JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Kaushik Sarkhel, Advocate For the State : Mr. Anup Pawan Topno, A. P. P. ----- Order No. 04 Date: 10. 12. 2024 1. The petitioner is apprehending his arrest in connection with Govindpur P. S. Case No. 207 of 2018 corresponding to G. R. Case No. 2901 of 2018 registered under Sections 420/406/467/468/ 471/120-B/34 of the Indian Penal Code, 1860. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the complaint leading to lodging of the F. I. R.

It has been alleged that the petitioner and other co-accused persons being officials of Silicon Group Companies opened an office of the said company at Govindpur in the year 2010. They published advertisement in different newspapers and took deposit of almost Rs. 1. 50 crores from different investors. As per the promise, the investors did not receive their maturity amount. It has further been alleged that the informant being the agent of the said company went to the head office of the said company but the same was found closed and when he met the petitioner and other co-accused person, they refused to return the money to the investors. 3. It is further submitted that in fact, the petitioner had already resigned from the company-Silicon Projects India Limited as would be evident from his resignation letter th dated 20 May, 2013 (Annexure-2 to the present anticipatory bail application) and Form-32 (Annexure-3 to the present anticipatory bail application).

Otherwise also, it has not been averred in the complaint that any of the investors invested money in the said company on being allured by the petitioner. Similarly situated co-accused-Shibnarayan Das has already been granted anticipatory bail by a Bench of this Court vide order dated nd 2 May, 2024 passed in A. B. A. No. 1459 of 2024. He, however, undertakes to co-operate in the ongoing investigation. Hence, he may be given the privilege of anticipatory bail. 4. Learned A. P. P. opposes the petitioner’s prayer for grant of anticipatory bail. 5. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner, above named, in the event of his arrest or -2- A. B. A.
