IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 7329 of 2024 ----- Rabindra Kumar Mishra, S/o Karunakar Mishra, R/o Khurunti, Brahman Sahi, Danagadi, Khurunti, P. O. & P. S. - Khurunti, District-Jaipur, Odisha. .......... Petitioner. -Versus- The State of Jharkhand .......... Opp. Party. ----- CORAM : HON’BLE MR. JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Neeharika Mazumdar, Advocate For the State : Mr. Sunil Kumar Dubey, A. P. P. ----- Order No. 04 Date: 09. 12. 2024 1. The petitioner apprehending his arrest in connection with Mango P. S. Case No. 189 of 2023 for the offences punishable under Sections 12(1)/12(2)/12(3) of Jharkhand Bovine Animals (Prohibition of Slaughter) Act, 2005 and under Section 11 of Cruelty to Animals Act, 1960, has prayed for grant of anticipatory bail. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F. I. R.
There is alleged recovery of 6 bovine animals from a vehicle bearing registration no. OR-05AA-1152 (as mentioned in the F. I. R. ). The petitioner has been implicated in this case in the capacity of being the owner of the said vehicle. It has, however, been stated in paragraph no. 10 of the present anticipatory bail application that the said vehicle is registered in the name of one Sourav Jena, son of Shayam Sunder Jena. The petitioner has neither any concern with the said vehicle nor with the animals so recovered. The petitioner has no criminal antecedent as has been stated in paragraph no. 15 of the present anticipatory bail application. He, however, undertakes to co-operate in the ongoing investigation. Hence, he may be given the privilege of anticipatory bail. 3. Learned A. P. P. opposes the petitioner’s prayer for grant of anticipatory bail. 4.
Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on anticipatory bail. 5. Accordingly, the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of st learned Judicial Magistrate 1 Class, Jamshedpur in connection with Mango P. S. Case No. 189 of 2023 subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Rajesh Shankar, J. ) Vikas/ -2- A. B. A. No. 7329 of 2024
