Item No. 24 Digitally signed by KHOIROM KHOIROM IN THE HIGH COURT OF MANIPUR BIPINCHAND BIPINCHANDRA SINGH Date: 2024. 12. 10 AT IMPHAL RA SINGH 16:31:23 +05'30' W. A. No. 87 of 2023 State of Manipur & Anr. … Appellants - Versus - Kh. Kiranmala & 2 Ors. … Respondents B E F O R E HON’BLE THE CHIEF JUSTICE MR. D. KRISHNAKUMAR HON’BLE MRS. JUSTICE GOLMEI GAIPHULSHILLU 09. 12. 2024 [D. Krishnakuamr, CJ] Heard Mr. S. Nepolean, learned senior counsel appearing for the appellants and Mr. Rendy Maibam, learned counsel appearing for the respondents through VC. The present appeal has been filed against the order dated 24. 01. 2023 passed in W. P. (C) No. 62 of 2023. In paragraph No. 4 of the aforesaid order, it is clearly observed that the learned counsel appearing for the appellant has not yet got any instructions from the authorities whether the authorities have taken a decision or not.
Considering the submissions made by the learned counsel appearing for the parties, the aforesaid order was passed directing the respondents/appellant herein to consider the cases of the petitioners/respondents herein for their promotion to the next higher post strictly in terms of the relevant Recruitment Rules and on the basis of the relevant final seniority list. P a g e 1 | 2 We are surprised to understand why the Government filed an appeal only for the direction which needs to consider the case of the respondents who raised representation if otherwise eligible in accordance with the Recruitment Rules and on the basis of the seniority list. However, it is satisfied that the prayer as sought is for considering the representation to aforesaid promotion to the higher post in accordance with law and on the basis of the seniority list.
Therefore, we clarify that the direction passed by the writ Court is to consider the case of the respondents by the appellant for promotion to the higher post in accordance with law and pass order within a period of 8 (eight) weeks from the receipt of the order. With the above, the present writ appeal is disposed of. JUDGE CHIEF JUSTICE Bipin P a g e 2 | 2
