A. ) No. 60 of 2023 State of Manipur; & Anr. Applicants Vs. Wairokpam Dutta Singh; & Anr. Respondents BEFORE HON’BLE THE CHIEF JUSTICE MR. SIDDHARTH MRIDUL HON'BLE MRS. JUSTICE GOLMEI GAIPHULSHILLU KABUI ORDER 24. 04. 2024. Siddharth Mridul, C. J. : Mrs. Ch. Sundari, learned G. A. , appears on behalf of the applicants; and Mr. H. S. Paonam, learned senior counsel, appears on behalf of the respondents. The present application has been instituted on behalf of the State of Manipur & anr.
, praying as follows:- “ In the premises stated above, Your Lordships’ may be graciously pleased to consider the reasons given in the foregoing paras and circumstances stated therein as the sufficient cause for condoning the unintentional delay of 640 days only in filing the accompanying Writ Appeal and the same be heard on merit as the ends of justice may call for. ” Mr. H. S. Paonam, learned senior counsel appearing on behalf of the non-applicants, whilst deprecating the lackadaisical attitude of the government, fairly states that he doesn’t oppose the limited relief prayed for in the application. We find ourselves in agreement with the submission made on behalf of Mr. H. S. Paonam, learned senior counsel, and caution the government to be more careful in future. In view of the foregoing and in the interest of justice, the delay of 640 days in filing the accompanying appeal is condoned. MC(WA) No. 60 of 2023 is allowed and disposed of accordingly.
Registry is directed to number the appeal if it is found to be in order and list the same for hearing. JUDGE CHIEF JUSTICE Indrajeet
