Respondent/s BEFORE HON’BLE MR. JUSTICE A. GUNESHWAR SHARMA Order 12. 01. 2024 [1] Heard Mr. Y. Nirmolchand, learned senior counsel assisted by Mr. L. Raju, learned counsel for the petitioner. [2] Issue notice. [3] Mr. Shyam Sharma, learned G. A. accepts notice on behalf of respondent Nos. 1 & 2. Hence, no formal step is required to be taken with respect to respondent Nos. 1 & 2. [3] Petitioner is directed to take step with respect to private respondent Nos. 3 to 10 by speed post as well as dasti service in addition through respondent No. 2. [4] Mr. Y. Nirmolchand, learned senior counsel, submits that WP(C) No. 386 of 2022 is listed on 25. 01. 2024 and in the said writ petition, the petitioner is one of the private respondents. It is stated that publication of the impugned senior list dated 29. 12.
2023 during pendency of WP(C) No. 386 of 2022 is with malafide intention and prayed for staying the same. [5] Mr. Shyam Sharma, learned G. A. , submits that issuing tentative seniority list dated 29. 12. 2023, 21 days is given to all the incumbents to file any objection, if any and prays that tentative seniority list may not be stayed. It will delay in the whole process and the incumbents may submit and the State may be allowed to process the same. [6] Learned senior counsel for the petitioner is agreeable to the submission of the learned G. A. provided no final seniority list shall be published. [7] Recording the submissions made at the bar, there is no stay in processing the objections submitted by the incumbents with respect to tentative seniority list dated 29. 12. 2023. However, final seniority list shall not be published without the leave of this Court. [8] List on 25. 01. 2024 along with WP(C) No. 386 of 2022. [9] Petitioner is directed to file affidavit of proof of service.
[10] Learned counsel appearing for the parties submit that in view of the order passed in the main petition, MC(WP(C) No. 9 of 2024 may be closed.
