HIGH COURT OF TRIPURA AGARTALA CRL. PETN NO. 28 of 2023 Shri Barasa Mani Jamatia ……Petitioner(s) Versus Smt. Lila Debi Jamatia ..... Respondent(s) For the Petitioner(s) : Mr. I. Chakraborty, Advocate. For the Respondent(s) : Mr. A. Debbarma, Advocate. Mr. B. Debbarma, Advocate. Date of hearing and delivery of Judgment & Order : 18. 03. 2024 Whether fit for reporting : YES/NO. HON’BLE MR. JUSTICE T. AMARNATH GOUD J U D G M E N T & O R D E R(ORAL) The instant criminal revision petition is preferred under Section 482 of the Cr. P. C. for setting aside of an order dated 04. 07. 2023 passed in Criminal Revision No. 10 of 2022 preferred by the petitioner himself before the learned Additional Sessions Judge, Gomati Judicial District. 2. Heard Mr. I. Chakraborty, learned counsel appearing for the petitioner-husband as well as Mr. A. Debbarma, learned counsel appearing for the respondent-wife. 3. Mr. I.

Chakraborty, learned counsel appearing for the husband-petitioner submits that the wife-respondent had left the husband-petitioner for the past 12 years and she is staying with another man with her two children. The wife respondent has separate ration card and ROR. Learned counsel further submits that his client is a contractual staff and earns a meager amount of about Rs. 12,000/-. With the said amount, his client has to maintain himself and his old-aged father. As such, learned counsel urged this Court to allow this appeal. 4. On the other hand, Mr. A. Debbarma, learned counsel appearing for the wife-respondent submits that the petitioner is a very cruel person and she is not willing to live together with the husband-petitioner. 5. Heard and perused the evidence on record. 6. It is seen from the record the Trial Court in its impugned order dated 04. 07. 2023 awarded a maintenance amount of Rs. 5,000/- only to the wife-respondents herein to be paid by the petitioner-husband.

This Court feels that the said impugned Order is just and proper. The same has been passed after considering all the aspects and needs no further interference. 7. Accordingly, this present writ petition stands dismissed. As a sequel, stay if any stands vacated. Pending application(s), if any also stands closed.
