Present contempt application has been preferred by the applicant for initiating the contempt proceedings against the respondents and punish them for non compliance of the judgement and order dated 15. 03. 2024 passed by this Court in Matters Under Article 227 No. 1308 of 2024 titled as 'Neelam Yadav vs. Tehsildar, Tehsil Bikapur, District Ayodhya and Ors. ' From perusal of the order sheets enclosed collectively with the present petition as Annexure no. 3, it reveals that the case was fixed on 47 dates, out of which on about 40 dates, the lawyers were abstaining from judicial work.
Under these circumstances, no direction can be issued to the OfÏcer concerned to decide the case expeditiously. Contempt petition is dismissed accordingly. At this stage, learned counsel for the applicant has submitted that the applicant may be permitted to appear in person before the respondent and the respondent may be directed to decide the case. Applicant is at liberty to move an application to appear in person before the court below and in case, any such application is preferred by the applicant to appear in person, the matter may be heard in accordance with law.
