IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No. 7005 of 2025 Satyajit Sahu …. Petitioner Mr. B. S. Mishra, Advocate -versus- State of Odisha …. Opposite Party Mr. C. R. Swain, AGA CORAM: JUSTICE V. NARASINGH ORDER 22. 12. 2025 Order No. 02. 1. Heard learned counsels for the Petitioner and learned counsel for the State. 2. The Petitioner is seeking pre-arrest bail in connection with C. T. Case No. 373 of 2025 pending on the file of learned SDJM, Udala, arising out of Kaptipada P. S. Case No. 92 of 2025 for commission of offences punishable under Sections 201, 416, 420, 463, 467, 470, 472, 474, 120-B of the IPC read with Section 66(C) of the IT Act, 2000. 3. The allegations against the Petitioner is that he has supplied three activated SIM cards and there is material on record as stated by the learned counsel for the State that, which is attributed to the present Petitioner for asking the person(s) receiving the SIM cards to keep it activated. 4.
It is submitted by the learned counsel for the Petitioner that the identical allegations were made in Jasipur P. S. Case No. 121 of 2025 and the present Petitioner has since been released on bail by order dated 13. 05. 2025 by the learned Addl. Sessions Judge, Karanjia in B. A. No. 87 of 2025. Taking into account the same and the role ascribed to the Petitioner, it is submitted that he may be protected by pre-arrest bail. 5. Learned counsel for the State on the basis of the Case Diary intimates this Court that the matter is of a sensitive nature and has international ramifications, as some of the SIM cards are traced to Cambodia. Hence, he ought not to be protected by pre-arrest bail. 6. Taking into account the complexity of the investigation, this Court is persuaded to hold that protecting the petitioner by pre-arrest bail at this stage would derail the ongoing investigation.
Hence, this Court is not inclined to entertain the application for grant of exceptional remedy of pre-arrest bail. However, in the event the Petitioner surrenders before the learned Court in seisin and moves an application for his release on bail, the same shall be considered on its own merit. Question of parity, if any, may be considered by the learned Court (s) in seisin. 7. Accordingly, the ABLAPLs stand disposed of. U. C. C. as per rules. (V.
