Das, ASC CORAM: JUSTICE V. NARASINGH ORDER 03. 12. 2025 Order No. 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is seeking pre-arrest bail in connection with C. T. Case No. 776 of 2025 pending on the file of learned J. M. F. C. (City), Balasore, arising out of Balasore Sadar P. S. Case No. 422 of 2025 for commission of offences punishable under Sections 126(2), 296, 115(2), 132, 221, 109, 351(3), 3(5) of BNS. 3. It is submitted by the learned counsel for the Petitioner that F. I. R. has been instituted by police personnel the Petitioner is not a named accused and taking into account the nature of allegations, the Petitioner may be protected by pre-arrest bail. 4. Learned counsel for the State opposes such prayer. 5.
Considering the nature of allegations, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent and nature of injury. 6. If it comes to fore that the Petitioner has any criminal antecedent and injury suffered by the injured is grievous, this order shall not be given effect to. 7. It is needless to state that the Petitioner shall cooperate with the ongoing investigation. 8. Accordingly, the ABLAPL stands disposed of. (V.
