( 3) Pet it ioners were init ially appoint ed as PTA Teacher against sanct ioned vacancy on t he post of Lect urer in a governm ent aided inst it ut ion w. e. f. 26. 2. 1996; t hey were given ad hock st at us of Lect urer w. e. f. 1. 7.
2009 and t heir services w ere regularised on t he post of Lect urer w. e. f. 17. 11. 2015. The Com m it t ee of Managem ent det erm ined t he seniorit y of lect urers serving in t he said inst it ut ion, in which Raj esh Prasad Dangwal ( pet it ioner in WPSS/ 786/ 2025) has been placed at serial no. 1, while Soukar Singh Rawat ( pet it ioner in WPSS/ 442/ 2025) has been placed at serial no. 2 by t reat ing him t o be j unior t o Raj esh Prasad Dangwal. The post of Principal in t he concerned school had fallen vacant on 31. 3. 2025 and charge of t he said post was given t o Raj esh Prasad Dangwal by virt ue of his posit ion in t he seniorit y list . However, pursuant t o an int erim order passed in WPSS/ 442/ 2025 on 4. 4. 2025 by coordinat e Bench of t his Court , charge of 2025:UHC:9752 officiat ing Principal was given t o Soukar Singh Rawat .
( 4) Learned St at e Counsel point s out t hat det erm inat ion of seniorit y m ade by t he Com m it t ee of Managem ent is appealable before t he Regional Addit ional Direct or of Educat ion. He subm it s t hat if Soukar Singh Rawat has any grievance against det erm inat ion of seniorit y, as m ade by Com m it t ee of Managem ent , t hen he should have approached t he appellat e aut horit y. ( 5) This Court finds subst ance in t he said subm ission. Since Raj esh Prasad Dangwal has been placed on t op of seniorit y list , t herefore, Soukar Singh Rawat cannot hold charge of officiat ing Principal any m ore. However, having regard t o t he fact s and circum st ances of t he case, writ pet it ions are disposed of w it h libert y t o Soukar Singh Rawat t o file appeal before t he appropriat e aut horit y in t he depart m ent . I f he files appeal w it hin t en days from t oday, decision t hereupon shall be t aken w it hin four weeks t hereaft er.
Only for a period of t hree weeks, st at us quo as regards charge of officiat ing Principal of t he concerned inst it ut ion shall be m aint ained. ( 6) I t goes w it hout saying t hat all persons likely t o be affect ed by t he decision t o be t aken on appeal of Soukar Singh Rawat shall also be heard by t he appellat e aut horit y.
