JUSTICE RAJESH SHANKAR ----- For the Petitioners : Mr. Santosh Kumar, Advocate For the State : Ms. Nehala Sharmin, Spl. P. P. ----- Order No. 03 Date: 06. 12. 2024 1. The petitioners are apprehending their arrest in connection with C. P. Forest Case No. 631 of 2020 registered under Section 33 of the Indian Forest Act, 1927. 2. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and have not committed any offence as alleged in the offence report.
As per the allegation, the petitioners were found encroaching 75 decimals of forest land situated over Plot No. 5339 inside Narayanpur Afforestation Area, which is a protected forest notified vide notification No. CF/17014/58- th 1429-R, dated 24 May, 1958 and sowed paddy crops over the said land. It is further submitted that the petitioners were not involved in cultivation over the forest land as has been alleged. They have been implicated in this case merely on hearsay statements of some villagers. Except that, there is no other cogent material to connect the petitioner with the alleged offence. They, however, undertake to co-operate in the trial. Hence, they may be given the privilege of anticipatory bail. 3. Learned A. P. P. opposes the petitioners’ prayer for grant of anticipatory bail. 4. Having heard learned counsel for the parties and on consideration of the materials available on record, I am inclined to enlarge the petitioners on anticipatory bail.
Accordingly, the petitioners, above named, in the event of their arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of st learned Judicial Magistrate 1 Class, Bokaro in connection with C.
