Saha, Advocate. 13. 09. 2024 Order This present petition has been filed seeking the following reliefs:- “(1) Issue a Writ of Mandamus or any other nature directing/ mandating the Respondent authorities to comply with the Memorandum dated 16-08-1978, vide No. F. 8(3)-FIN (G)/ 78 (ANNEXURE 4) and the Memorandum dated 25-02-2010, vide No. F. 8(3)-FIN (G)/78 (ANNEXURE-5). (ii) Issue a Writ of Mandamus any other nature directing/ mandating the Respondents to revise his pay scale to the tune of Rs. 2050-2890/-, to be effective from 2017 and to pay the arrears along with 12% interest.
(iii) Issue a writ of Mandamus or any other appropriate writ, order, or direction, directing the Respondents to rectify the service records of the Petitioner and grant the retiral benefits due to him. (iv) Issue a writ in the nature of mandamus or any other, directing/ mandating the Respondents to comply with the demand notice dated 23-07-2024(ANNEXURE-8). (v) Pass any other order(s) as this Hon'ble Court may deem fit and proper in the interest of justice. ” 2. Heard Mr. D. J. Saha, learned counsel appearing for the petitioner as well as Mr. Mr. D. Bhattacharjee, learned Sr. counsel assisted by Mr. S. Saha, learned counsel appearing for the respondents. 3. It is seen from the record that the petitioner has served a legal notice though his legal counsel on 23. 07. 2024 before respondents No. 2 and 3 agitating his grievance, but, the same is pending till date.
As such, without expressing any opinion on its merit, this present writ petition is disposed with a direction upon the respondent Nos. 2 and 3 i. e. , The Secretary Finance, Department of Finance, Government of Tripura and The Director, Directorate of Social Welfare and Social Education Department Malancha, Ujan Abhoynagar, Agartala Tripura to consider the case of the petitioner in accordance with law within a period of 3(three) months from the date of receipt of the copy of this Order and communicate the said decision to the petitioner. 4. With the above observation and direction, this present writ petition stands disposed of. As a sequel, stay if any stands vacated. Pending application(s), if any also stands closed.
