Kuru, District-Lohardaga ...... … Petitioners Versus The State of Jharkhand . …. … Opposite Party -------- CORAM: HON'BLE MR. JUSTICE SANJAY KUMAR DWIVEDI For the Petitioners :Mr. Jitendra S. Singh, Advocate Mr. Ashish Kumar, Advocate For the State : Mr. Rakesh Kumar Sinha, A. P. P. 03/ 20. 12. 2025: Heard learned counsel for the petitioners and learned counsel for the State. 2. The petitioners are apprehending their arrest in connection with Kuru P. S. Case No. 08 of 2025, corresponding to G. R. Case No.

151 of 2025, registered under sections 351(3), 61, 109 and 3 (5) of BNS and section 25(1-B) a, 27, 35 of Arms Act and vide order dated 05. 03. 2025 section 103(1) of BNS has been added, pending in the Court of learned Judicial Magistrate, Ist Class at Lohardaga. 3. Learned counsel for the petitioners submits that petitioners have been implicated in this case merely on suspicion. He next submits that petitioners have been implicated in this case only on the ground that the petitioners were also accused in S. T. No. 72 of 2024 arising out of Kuru P. S. Case No. 13 of 2024. He next submits that the petitioners were not present at the spot and since the petitioners were accused in S. T. No. 72 of 2024 allegations are made that on the instigation of petitioners firing was made. He also submits that on firing of the assailants deceased has died who alleged to be accomplice of the petitioners.

He then submits that if any case is made out that is under section 102 of BNS and not under section 103(1) of BNS. He further submits that two of the accused persons have been granted anticipatory bail in A. B. A. No. 3056 of 2025 by a Co-ordinate Bench of this Court. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that in the case diary it has come that petitioners have two criminal antecedents and connivance of the petitioners cannot be ruled out and in view of that anticipatory bail may kindly be rejected. 5. In reply, learned counsel for the petitioners submits that in one case petitioners have been acquitted and in another case petitioners are on bail. 6. In view of above and looking into contents of F. I. R, it transpires that only on suspicion the petitioners have been made accused as they were accused in S. T. No.

72 of 2024 and the petitioners have been suspected that they are instigator of firing by the assailants due to which deceased has died and further two of co-accused persons have been granted anticipatory bail in the aforesaid A. B. A by the Co-ordinate Bench of this Court. 7. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class at Lohardaga, in connection with Kuru P. S. Case No. 08 of 2025, corresponding to G. R. Case No. 151 of 2025, subject to conditions as laid down under Section 482 (2) of B. N. S. S, 2023. Dt. 20. 12.
