Mr. Raju Datta, learned PP submits that he has no objection if the leave prayer is allowed and matter is taken up on merit for final hearing. Ms. Saswati Nag, learned counsel appearing for respondent No. 1, submits that the learned Trial Court was justified in rejecting the case of the complainant and that no perversity has been committed by the learned Trial Court in appreciating the evidence. Considered the submissions. Perused the record. As it appears, the matter is required to be heard on merit. Accordingly, the prayer for leave to appeal is allowed.
