HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S. B. Civ. Contempt Pet. No. 46/2023 Bhanwar Khan S/o Shri Mohan Khan, Aged About 62 Years, B/c Musalman R/o Chungi Chouki Gajner Road Bangla Nagar, Bikaner. ----Petitioner Versus 1. Tejasvi Gautam, Superintendent Of Police, Bikaner. 2. Balwant Kumar, Sho, Police Station Kolayat, District Bikaner. 3. State Of Rajasthan, Through P. p. ----Respondents For Petitioner(s) : Mr. M. S. Purohit Mr. Amit Kumar Purohit For Respondent(s) : Mr. Deepak Chandak, AAAG for Mr. B. L. Bhati, AAG JUSTICE DINESH MEHTA Order 13/02/2025 1. By way of present contempt petition, the petitioner has alleged non-compliance of the order dated 25. 11. 2022, whereby the Court had directed the Superintendent of Police to consider the documents and representation submitted by the petitioner and to conclude the investigation expeditiously. 2. The reply of the contempt petition has been filed and a copy of the negative final report has been produced. 3. Mr.

Deepak Chandak, learned counsel for the respondent submitted that the petitioner’s representation has been considered and final report has been produced. (2 of 2) [CCP-46/2023] 4. At this juncture, learned counsel for the petitioner contended that the Investigating Officer has not at all considered petitioner’s representation and documents which he had filed. 5. Heard learned counsel for the parties. 6. A perusal of the final order, more particularly, page 44 thereof, it is clear that the Investigating Officer has recorded that the complainant has not produced any documentary evidence including photo, video and audio etc. by which it can be concluded that he has been socially boycotted. Such stipulation shows that petitioner’s view point and documents have been considered. 7. According to this Court, if the petitioner is not satisfied with the conclusion of the investigation, he has to avail remedy available under the law.

Simply because, the conclusion of the investigation is not in his favour, the respondents cannot be alleged to be in contempt of the order passed by this Court. 8. Notices of contempt are hereby discharged. 9. The contempt petition is therefore, dismissed. (DINESH MEHTA),J 99-Arun/-
