Fayaz Ahmad Lone and others ... Respondent(s) Through: Mr. M. A. Beigh, Advocate CORAM: HON’BLE MR. JUSTICE ATUL SREEDHARAN, JUDGE HON’BLE MS. JUSTICE MOKSHA KHAJURIA KAZMI, JUDGE O R D E R 16. 02. 2024 The present appeal has been filed by the appellants who are aggrieved by the order dated 16. 12. 2020 passed in SWP No. 1588/2015, whereby there was a direction by the learned Single Judge to appoint the petitioners of Group C post on compassionate grounds. Learned counsel for the appellants has submitted that such an order directing appointment could not have been in a case of compassionate appointment and learned Single Judge could have only directed the appellants herein to consider the case of the respondents herein for compassionate appointment.

We have gone through the order that was originally impugned in the writ petition is perfunctory and does not give any reasons by referring to the specific facts of the case of the respondents as to why the application for compassionate appointment was rejected. Under the circumstances, the impugned orders dated 21. 08. 2012 and 04. 05. 2012 are set aside with a direction to the appellants to reconsider the applications for compassionate appointment of the respondents within a period of ninety days from today with reference to the scheme/rules prevalent at the time when the respondents had applied for compassionate appointment and not of any subsequent Scheme. With the above, this appeal is finally disposed of. (MOKSHA KHAJURIA KAZMI) (ATUL SREEDHARAN) JUDGE JUDGE SRINAGAR: 16. 02. 2024 ARIF
