( 2026:JHHC:11918 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B. A. No. 3253 of 2026 ------ Sudhir Kumar Singh, aged about 29 years, son of Manejar Singh, resident of Vill-Jasholi Radal Hata, P. O. & P. S. -Panchrukhi, District- Siwan, Bihar. .... .... …. Petitioner Versus The State of Jharkhand .... .... .... Opposite Party ------ CORAM : HON'BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. A. K. Kashyap, Sr. Advocate : Mr. Anurag Kashyap, Advocate For the State : Mr. Bhola Nath Ojha, Spl. P. P ------ Order No. 02 Dated- 22-04-2026 Heard the parties. The petitioner has been made accused in connection with NDPS Case No. 04 of 2024 arising out of Jaldega (Bansjore O. P. ) P. S. Case No. 16 of 2024 registered for the offences punishable under Sections 20 & 22 of NDPS Act. This is the third journey of the petitioner with the prayer for regular bail, earlier the prayer for regular bail of the petitioner was twice rejected vide order dated 17. 10. 2024 in B. A. No.
6792 of 2024 and order dated 04. 04. 2025 in B. A. No. 2576 of 2025. Learned counsel for the petitioner submits that the fresh ground is that in the meanwhile, three witnesses have been examined so far, out of which PW-1 & PW-2 have not supported the case of the prosecution and declared hostile, but the PW-3 who is police constable has categorically stated regarding recovery of Ganja of 5. 245 Kg from the possession of the petitioner while the same was transported by the petitioner. It is next submitted that the petitioner undertakes that he will co-operate with the trial of the case. It is lastly submitted that the petitioner has been in custody for about more than two years. It is next submitted that the co-accused has been granted bail by the co-ordinate bench of this Court vide order dated 13. 09. 2024 in B. A. No. 6165 of 2024. Hence it is submitted that the petitioner be admitted to bail. Learned Spl. P. P.
appearing for the State vehemently opposes the prayer for bail and submits that since PW-3 has categorically stated about recovery of Ganja from the possession of the petitioner while the same was being transported and the petitioner is a habitual offender of committing the offences punishable under the penal provisions of NDPS Act as at least in two cases besides this case out of the total six other cases in which the petitioner is involved are the offences involving NDPS Act Cases, hence, there is every chance of the petitioner indulging in illegal sale and purchase of Ganja and there is every chance of the petitioner absconding or tampering with evidence, if released on bail. It is therefore submitted that the petitioner ought not be released on bail.
Considering the serious nature of allegation against the petitioner as well as the fact that the prayer for bail of the petitioner has been rejected twice as also the deposition of PW-3 and the chance of the petitioner absconding or tampering with evidence, if released on bail, this Court is not inclined to admit the petitioner on bail at this stage. Accordingly, the prayer for bail of the above-named petitioner is rejected at this stage. (Anil Kumar Choudhary, J. ) 22/04/2026 Abhiraj/
