No. 9764 of 2024 Ujjwal Kumar @ Ujjwal Kumar Singh, aged 27 years, son of late Mahesh Singh, resident of village- Sallaya, P. O. - Sallaya, P. S. - Herhanj, Dist. - Latehar. … Petitioner - Versus - The State of Jharkhand … Opp. Party ------ CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH ----- For the Petitioners : Mr. Prashant Kr. Rahul, Advocate : Mr. Binod Kr. Dubey, Advocate For the State : Mr. Santosh Kr. Shukla, A. P. P. : Mr. Rakesh Kumar Sinha, A. P. P. --- 04/18. 12. 2024 Both these Bail Applications arise out of same police case. Accordingly, both these Bail Applications are being disposed of by a common order. Heard the parties. The petitioners have been made accused in connection with Herhanj P. S. Case No.
26 of 2024, for the offences registered under Sections 140(2), 3(5), 61(2) of the B. N. S. , 2023, pending in the court of learned Chief Judicial Magistrate, Latehar. On 29. 07. 2024 at about 6:00 P. M. , the informant Akhilesh Kumar Yadav and one Girendra Yadav were abducted by petitioners and co-accused persons. They were taken to an isolated place. They were brutally assaulted. Using the mobile phone of the informant, ransom was demanded from his father. It appears that the petitioner Ujjwal Kumar @ Ujjwal Kumar Singh forced the informant to go to a C. S. P. Kiosk and withdraw Rs. 1 lakh from there. The proprietor of C. S. P. Kiosk has supported this fact in his statement under Section 180 of B. N. S. S. It further appears that petitioner Ujjwal Kumar @ Ujjwal Kumar Singh had gone to collect ransom from the house of the informant, but in the meantime police arrived and the accused persons leaving the victims fled away. Both the petitioners were apprehended together.
Considering the nature of allegations, I am not inclined to release the petitioners, on bail. Accordingly, their prayer for bail stands rejected. (Ambuj Nath, J. ) Jay/-
