IN THE HIGH COURT OF ORISSA AT CUTTACK W. A. No. 95 of 2024 State of Odisha and others …. Appellants Mr. S. B. Mohanty, AGA -Versus- Kahara Mahananda …. Respondent CORAM: JUSTICE KRISHNA SHRIPAD DIXIT JUSTICE CHITTARANJAN DASH ORDER Order No. 06. 04. 2026 01. W. A. No. 95 of 2024 and I. A. No. 305 of 2024 This Intra-Court appeal preferred by the State and its functionaries seeks to lay a challenge to a learned Single Judge’s order dated 10. 08. 2022, whereby relief has been accorded to Respondent-Employee in terms of an order in W. P. (C) No. 7281 of 2018 between State of Odisha v. Saraswati Bhoi and also W. P. (C) No. 4848 of 2021 between State of Odisha v. Nilamani Behera disposed off vide Common Judgment dated 24. 06. 2022 by a Co-ordinate Bench of this Court. 2. Despite some submission, learned AGA is not in a position to differentiate the facts of the case from those involved in Saraswati Bhoi supra.
Added, there is enormous delay of 509 days for condoning which, the application in I. A. No. 305 of 2024 supported by affidavit has been moved. We are not impressed with the explanation offered in the application/affidavit. Long delay needs a strong reason for condonation. That is not there. In the above circumstances, application in I. A. No. 305 of 202 is rejected & Appeal is also. The impugned order of the learned Single Judge shall be given effect to within eight weeks reckoned from this day, failing which the Appellants run the risk of contempt proceedings. Registry to send a copy of this order to the Respondent- Employee by speed post immediately. Web copy of order to be acted upon by all concerned. (Krishna Shripad Dixit) Judge ( Chittaranjan Dash ) Judge Anisha
