Samal, Advocate CORAM: JUSTICE KRISHNA SHRIPAD DIXIT JUSTICE CHITTARANJAN DASH ORDER Order No. 09. 04. 2026 03. This Intra-Court appeal seeks to assail a learned Single Judge’s order dated 01. 08. 2025, whereby Appellant’s W. P. (C) No. 31072 of 2024 has been negatived. In the said Petition, she had called in question the notice dated 29. 11. 2024 issued by the Sub-Collector, Baliguda in connection with No Confidence Motion initiated against her. A Coordinate Bench of this Court had referred certain questions arising in the Appeal for the consideration of Full Bench, which decided the Reference vide unanimous judgment dated 29. 11. 2025 vide Nabanita Kapat Patra v. Collector, Kandhamal, 2025 (III) ILR-CUT-1221. The questions raised both on law and facts have been answered in favour of the Appellant.
In view of the above, this Appeal is allowed; the impugned order of the learned Single Judge is set at naught; Appellant’s W. P. (C) No. 31072 of 2024 having been favoured, a Writ of Certiorari issues quashing the Notice of No Confidence dated 29. 11. 2024 at Annexure-1; as a consequence, all further proceedings structured on the basis of said notice are voided. Concomitantly, the Appellant shall be reinstated in the Office of Sarpanch, Hatimunda, Kandhamal with immediate effect. However, nothing stated hereinabove shall come in the way of any fresh Motion of No Confidence being taken up in accordance with law. Costs made easy.
