He submits that, thereafter, the statements of PW-3, PW-4, PW-5, PW-6, PW-7 and PW-8 have been recorded. Drawing the attention of the Court towards the FIR, learned counsel for the petitioner submits that the specific allegation of inflicting head injuries upon the injured has been levelled against co-accused Mukesh, who is alleged to have assaulted the injured with an iron rod. He submits that co-accused Mukesh has been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 08. 01. 2025 passed in [2026:RJ-JP:38165] (2 of 2) [CRLMB-3409/2026] S. B. Learned counsel for the complainant is in agreement and submits that the parties have arrived at a compromise and the complainant has no objection if the petitioner is enlarged on bail. 5. Per contra, learned Public Prosecutor opposes the bail application, however, he is not in a position to refute that the co-accused Mukesh has been enlarged on bail by the Co-ordinate Bench of this Court. Learned Public Prosecutor is also not in a position to dispute the fact that the parties have arrived at a compromise in order to resolve their dispute. 6. Having considered the submissions advanced at Bar by learned counsel for the parties and having regard to the entirety of facts and circumstances of the case as available on record; and looking to the fact that trial may take a long time to conclude and, without expressing any opinion on the merits/demerits of the case, this Court deems it fit to enlarge the petitioner on bail. 7. Consequently, the instant second bail application is allowed.
It is ordered that the accused petitioner Vishal @ Karan S/o Ramuram, arrested in connection with FIR No. 148/2024 dated 12. 08. 2024 registered at the Police Station Airport Jodhpur, District Jodhpur shall be released on bail; provided he furnishes a personal bond in the sum of Rs. 50,000/- and two sureties of Rs. 25,000/- each to the satisfaction of the learned trial Court, with a stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
