For Petitioner(s) : Mr. D Sarkar, Advocate. For Respondent(s) : Mr. P K Dhar, Sr. Govt. Advocate, Mr. Ratan Datta, Public Prosecutor. HON’BLE THE CHIEF JUSTICE MR. AKIL KURESHI _O_R_D_E_ R_ 17/12/2020 Petitioner’s son aged about 17 years was found dead in the house th hanging from a ceiling fan on 18 November, 2020. The petitioner had nd filed a written complaint stated to be delivered on 22 November, 2020 suspecting foul play and involvement of some of the residents of the locality. Case of the petitioner is that the said communication has not been registered as an FIR and no serious investigation has been carried out by the police agency. Appearing for the State authorities, learned Public Prosecutor th Mr. Ratan Datta stated that the petitioner’s letter was received on 27 November, 2020.

However, long before that from the concerned hospital Page - 2 of 2 information was received by the nearby Police Station about the unnatural death. Inquiry into such unnatural death has been instituted and is still going on. No final conclusion could be reached since FSL report is yet to be received. However, the police authorities are inquiring into the incident in full seriousness and earnest and if, at any stage, it is found that the case is one other than of suicide, appropriate FIR would be registered and investigation would be carried out. At this stage, there is no further material before me to go by and direct the police authorities to register a case of murder as is the desire of the petitioner. Let the inquiry into the nature of unnatural death be continued and it may be concluded as soon as possible. With these observations, the petition is disposed of at this stage. Pending application(s), if any, also stands disposed of. ( AKIL KURESHI, CJ) Sukehendu
