S C BISWAS Advocate for the Respondent : PP, ASSAM BEFORE HONOURABLE MR. JUSTICE AJIT BORTHAKUR ORDER Date : 03-12-2020 Heard Mr. S. C. Biswas, learned counsel for the petitioner. Also Heard Mr. N. K. Kalita, learned Addl. P. P. , Assam appearing for the State respondent as well as Mr. H. A. Laskar, learned counsel for the informant. By this second petition under Section 439 Cr. P. C. , the petitioner, namely Aftab Uddin Laskar has prayed for grant of bail in connection with Algapur P. S. Case No. 107/2020 Page No. # 2/2 registered u/s 420/409/294/352/34 of the IPC.

Be it mentioned here that the earlier bail application of the accused petitioner was rejected by this Court vide order, dated 12. 11. 2020, passed in Bail Appln. No. 2304/2020. Perusal of the FIR and accused Forwarding Report shows prima facie abundance of incriminating material against the accused petitioner. However, considering the length of detention of the accused, who is in judicial custody since 10. 10. 2020 (54 days), this Court finds that his further detention may not be necessary in the interest of investigation in the case. Therefore, it is provided that the accused/petitioner, named above, shall be released on bail of Rs. 25,000/- (Rupees Twenty Five Thousand) with one surety of like amount to the satisfaction of the learned C. J. M.

, Hailakandi subject to the following conditions-i) That the accused/petitioner shall cooperate with the Investigating Officer as and when required; ii) That the accused/petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Police Officer or the Court; iii) That the accused/petitioner shall not hamper or tamper with the investigation in any manner; and iv) That the accused/petitioner shall refrain from committing any similar offences in future of which he accused or suspected of commission. This disposes off the bail application. JUDGE Comparing Assistant
