Theprosecutioncase,inbrief,isthis: 2. On 22. 05. 2020,the Deputy Range Officer oft orestarea,gotdiscreetinformation,regarding cultivation o anja plants in forestarea and accordingly,he condut sarchofthewesternsideofCharakkolMountaininAttap y Reserve Forest,and observed thatthe busheswere cutan rmoved, the soil was ploughed and ganja plants wer ultivated. On hisarrival,with thisparty,few personswer B. A. Nos. 4733 & 5110 OF 2020 4 sen fleeing from the place,from a distance ofabout 75 meters. Consequently,O. R. No. 9/2020 wasregistered fort foresaid offences. Investigation revealed the involvemento teapplicantsalsoasaccused,alongwith2others. Botht pplicantswerearrestedon25. 06. 2020andcontinuetobein ustody. Theapplicantspraythattheyareinnocentand t llegationsthattheyareinvolvedincultivationofganjaisnot true. Itis also stated thatthey do nothave any crimin l ntecedents. They are sole bread winners oftheir family. nd,therefore,seekregularbail. 3.
Heard the learned counsel appearing for t pplicantsandthelearnedPublicProsecutor. 4. Considering the entirety of the facts n ircumstances ofthis case,the presentpandemic situation ndtheantecedentsoftheapplicants,Iam oftheopiniont t urtherincarcerationoftheapplicantsmaynotbenecessary. 5. In the result,the applicationsare allowed and t pplicantsaredirectedtobereleasedonbailontheexecution B. A. Nos. 4733 & 5110 OF 2020 5 ofbonds for Rs. 50,000/-(Rupees Fifty thousand only),e with two solventsureties,each for the like amountto t stisfactionofthejurisdictionalcourtandonfollowingfurt r onditions: (i) They shallappearbefore the Investigating Offi r onallMondaysbetween9. 00AM and12. 00PM foraperiodo two months or tillfiling of the finalreport whichever is arlier. (ii) Theyshallnotintimidateorinfluencewitnessesan tmperwithevidence. (iii) They shall not get involved in similar offen s uringthecurrencyofthebailperiod.
