[2026:RJ-JP:38017] HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S. B. Criminal Miscellaneous Bail Application No. 10559/2026 CNR: RJHC010796952026 | URN: CRLMB / 23047U / 2026 Jagjeet Singh Alias Jaggi S/o Dayal Singh, Aged About 37 Years, Resident Of Ward No. 2, Near Radhaswami Dera, Tibbi, Police Station Tibbi, District Hanumangarh (Presently Lodged In District Jail Hanumangarh) ----Petitioner Versus State Of Rajasthan, Through Public Prosecutor ----Respondent For Petitioner(s) : Mr. Pankaj Kumar Gupta Mr. Arshdeep For Respondent(s) : Mr. Surendra Bishnoi, PP HON'BLE MR. JUSTICE SANDEEP SHAH Order 10/08/2026 1. The applicant has filed the present bail application under Section 483 being aggrieved against the order dated 24. 07. 2026 passed by the learned Sessions Judge, Hanumangarh, in Criminal Misc. Case No. 521/2026, whereby the bail application filed by the accused-applicant under Section 483 B. N. S. S. was rejected.
The accused-applicant is behind the bars pursuant to the F. I. R. No. 55/2026 registered at Police Station Tibbi, District Hanumangarh against the accused-applicant for offences punishable under Sections 3 and 25 of Arms Act. 2. Learned counsel for the applicant submits that the firearm in question was recovered from co-accused Dhanna Singh @ Dhaniya. He submits that the accused-applicant has been implicated on the basis of the statement of co-accused Dhanna Singh @ Dhaniya. He also submits that no recovery has been [2026:RJ-JP:38017] (2 of 3) [CRLMB-10559/2026] effected from the accused-applicant and he has been implicated only on account of his criminal antecedents, inasmuch as, four cases are pending against him. He further submits that the main accused Dhanna Singh @ Dhaniya has already been enlarged on bail by this Court, vide order dated 09. 06. 2026 passed in S. B. Criminal Miscellaneous Bail Application No. 3363/2026 (Dhanna Singh @ Dhaniya v. State of Rajasthan).
He further submits that main accused Dhanna Singh @ Dhaniya also has criminal antecedents, inasmuch as, 14 cases are pending against him, though none of them is under the Arms Act. He further submits that the cases pending against the accused-applicant are also not under the Arms Act and pertain to minor offences under the provisions of IPC. He further submits that the accused-applicant is in judicial custody since 27. 03. 2026, the charge-sheet has already been filed and the trial is likely to take sufficiently long time to conclude. He, therefore, implores this Court to allow the present bail application of the accused-applicant. 3. Per contra, learned Public Prosecutor opposes the bail application. However, he is not in a position to dispute the fact that the firearm in question was recovered from Dhanna Singh @ Dhaniya and the accused-applicant has been implicated on the basis of the statement of Dhanna Singh @ Dhaniya. 4.
Heard learned counsel for the applicant and learned Public Prosecutor and perused the material available on record. 5. Having considered the arguments advanced by learned counsel for the parties and having regard to the facts and circumstances of the case, more particularly, the facts that the accused-applicant has been implicated on the basis of the [2026:RJ-JP:38017] (3 of 3) [CRLMB-10559/2026] statement of co-accused Dhanna Singh @ Dhaniya, co-accused Dhanna Singh @ Dhaniya has already been enlarged on bail by this Court, vide order dated 09. 06. 2026, no recovery has been effected from the accused-applicant, the accused-applicant is in judicial custody since 27. 03. 2026, the charge-sheet has already been filed and the trial is likely to take sufficiently long time to conclude, this Court prima facie finds it to be a case of consent and a fit case to enlarge the accused-applicant on bail. 6.
Thus, without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the accused-applicant on bail. 7. Consequently, the bail application under Section 483 B. N. S. S. is allowed. It is ordered that the accused-applicant; Jagjeet Singh Alias Jaggi S/o Dayal Singh, arrested in connection with F. I. R. No. 55/2026 registered at Police Station Tibbi, District Hanumangarh, shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs. 50,000/- and two sureties of Rs. 25,000/- each, to the satisfaction of learned Trail Court, for his appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial. 8. It is further, made clear that findings recorded/observations made herein-above are for limited purposes of adjudication of bail application and the same shall not prejudice the trial of the case in any manner.
