The instant petition has been preferred for seeking quashment of notice issued under endorsement dated 06. 08. 12, insofar as it pertains to the contractual appointment of respondent No. 5 to the post of Assistant Engineer. The petitioner has also sought a direction to the respondents to regularize his service in the post of Assistant Engineer, on which he has been performing duties for the last three and a half years, by promoting the petitioner to the said post. 02. Learned counsel for the petitioner submits that he has no instructions from his client whether he wants to pursue this case or not. 03.
Otherwise also, this matter was last listed on 22. 08. 2012, thereafter, it has been listed today. During this period, the petitioner has not taken any steps to get the matter listed. Had the petitioner been interested, necessary steps would have been taken by him to ensure the matter was listed. It is, therefore, clear that the petitioner has lost interest in pursuing the present writ petition. 04. Accordingly, this petition is dismissed for non-prosecution.
