[2025:RJ-JD:1567] HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S. B. Criminal Misc. Interim Bail Application No. 5124/2024 Girdhari Ram S/o Sh. Lala Ram, Aged About 30 Years, R/o Bhojasar Ps Bayatu Dist Barmer. (Lodged In Dist Jail Pratapgarh) ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Vijay Raj Bishnoi. For Respondent(s) : Mr. Shrawan Singh Rathore, PP. HON'BLE MR. JUSTICE KULDEEP MATHUR Order 09/01/2025 By way of filing the present interim bail application under Section 483 of BNS (439 Cr. P. C. ), the petitioner has prayed for grant of interim bail for a period of one month on the ground of his wife’s illness. A coordinate Bench of this Court, vide order dated 06. 08. 2024, directed the learned counsel for the petitioner to submit a separate comprehensive “medical history sheet” of the petitioner’s wife in the shape of an affidavit of petitioner himself/his father/mother/brother/sister etc. containing certain particulars.
In compliance of the dated 06. 08. 2024, learned counsel has filed an application bereft of any affidavit so directed in the order dated 06. 08. 2024. A perusal of the said application, it is amply manifest that the wife of the petitioner is suffering from some minor problem i. e. infection in uterus and there is no satisfactory [2025:RJ-JD:1567] (2 of 2) [CRLMB-5124/2024] averment made in the said application to substantiate that immediate presence of the petitioner is requisite in the present case or any impending surgical treatment of the petitioner’s wife is advised by the doctors. Having considered the material available on record and the nature and gravity of accusations against the present petitioner, this Court is not inclined to release the petitioner on interim bail. Accordingly, the interim bail application filed on behalf of the petitioner is hereby rejected. (KULDEEP MATHUR),J 153-Tikam/-
