IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 2768 of 2020 ------- 1. Ajay Kumar Mandal 2. Sumeshwar Yadav … … Petitioners Versus The State of Jharkhand … … Opposite Party ------- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY Through- Video Conferencing ------- For the Petitioners : Mr. Lakhan Chandra Roy, Advocate For the State : Ms. Nehala Sharmin, A. P. P. ------- 02/14. 12. 2020 Heard Mr. Lakhan Chandra Roy, learned counsel for the petitioners and Ms. Nehala Sharmin, learned A. P. P. for the State. Defects as pointed out by the office are ignored. The petitioners have prayed for grant of anticipatory bail, as they are apprehending their arrest in connection with Kunda P. S. Case No. 201/2019. Several tractors illegally loaded with sand were seized. The owners and drivers of the tractors with the assistance of others had got the tractors freed forcibly. The petitioner no. 1 appears to be the owner of the tractor bearing registration no.

JH 15U 9630 while the petitioner no. 2 is the driver. It has been stated by the learned counsel for the petitioners that the tractor was entrusted to the driver. In course of argument Mr. Roy, learned counsel for the petitioners submits that he is withdrawing this application so far as the petitioner no. 2 is concerned. This application stands dismissed as withdrawn as against petitioner no. 2. However, as regards the petitioner no. 1 is concerned he does not appear to have any antecedent and considering the fact that he was not present at the place of occurrence, I am inclined to extend the privilege of anticipatory bail to the petitioner no. 1. The petitioner no. 1 accordingly is directed to surrender before the learned court below within a period of -2-four weeks and on his surrender, he shall be released on bail on furnishing bail bond of Rs.

10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Deoghar in connection with Kunda P. S. Case No. 201/2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This application stands disposed off. (R. Mukhopadhyay, J. ) Alok/-
