K. Das, learned counsel for the petitioner and Mr. M. P. Goswami, learned Additional Public Prosecutor, State of Assam. This is an application under Section 438 of Cr. P. C filed by the petitioner, namely, Mrs. Tutumoni Bordoloi, praying for pre-arrest bail in connection with Morigaon P. S. Case No. 550/2020, registered under Sections 447/326/307/34 of the IPC. Perused the FIR and the CD of the case.
It appears from the CD and the medical report that injuries suffered by the Page No. # 2/2 complainant are simple. In view of that and the fact that the petitioner herein is a woman of 40 years of age, she is granted anticipatory bail as prayed for. As such, the interim order dated 15. 10. 2020 is hereby made absolute. However, since the learned P. P. submits that the petitioner has not appeared before the I. O. of the case, she is directed to do so so that her statement can be recorded and necessary formalities of the investigation are completed. Accordingly, this petition stands disposed of.
