By means of present C482 application, applicants have sought the indulgence of this Court for quashing the impugned charge-sheet dated 21. 12. 2017, summoning order dated 07. 02. 2018 as well as the entire proceedings of Criminal Case No. 559 of 2018, State vs. Darshan Singh & others, under Sections 147, 148, 323, 325 & 504 IPC, st pending in the court of learned 1 Additional Civil Judge, Kashipur, District Udham Singh Nagar. 2.
Today, the matter is taken up in the National Lok Adalat being held in the premises of the High Court of Uttarakhand. 3. Along with C482 application, a joint compounding application (IA No. 1/2024) has also been moved by the parties, supported by their separate affidavits. 4. Both the parties i. e. applicants and respondent no. 2-informant, respondent no. 3-injured & respondent no. 4 are present before the National Lok Adalat, being duly identified by their respective Advocates. In the compounding application, it is pleaded that parties have settled their dispute amicably, want to live their life peacefully and do not want to pursue this criminal case anymore. 5. Since the parties have entered into compromise, therefore, there is no useful purpose for keeping this criminal case pending and it will be a futile exercise to ask the applicants to appear before the court below as accused to face the trial. 6.
Accordingly, the present C482 application is allowed in terms of the compromise entered into between the parties terms whereof have been narrated in the compounding application. The said compromise shall form part of this judgment. 7. Consequently, the summoning order dated 07. 02. 2018 as well as the entire proceedings of Criminal Case No. 559 of 2018, State vs. Darshan Singh & others are hereby quashed.
