IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 4036 of 2020 ------- 1. Bachan Mahto 2. Usha Devi 3. Mamta Kumari … … Petitioners Versus The State of Jharkhand … … Opposite Party ------- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY Through- Video Conferencing ------- For the Petitioners : Mr. Anurag Kumar, Advocate Mr. Sanjay Kr. Pandey, Advocate For the State : Mr. A. K. Tiwari, A. P. P. ------- 02/15. 12. 2020 Heard Mr. Anurag Kumar, learned counsel for the petitioners and Mr. A. K. Tiwari, learned A. P. P. for the State. Defects as pointed out by the office are ignored. Earlier the prayer for bail of the petitioners was rejected in A. B. A. No. 1548 of 2020. The petitioners have renewed their prayer for bail on the ground that the husband of the informant has been granted anticipatory bail by this Court in A. B. A. No. 1596 of 2020. At the outset, Mr. Anurag Kumar, learned counsel for the petitioners submits that the petitioner no.
1 has been arrested and therefore he be permitted to withdraw this application so far as the petitioner no. 1 is concerned. In view of the said submission, this application stands withdrawn as against petitioner no. 1. So far as the other two petitioners are concerned they are the mother-in-law as well as the sister-in-law of the informant. The primary reason for rejection of the prayer for bail of the petitioners in A. B. A. No. 1548 of 2020 appears to be on account of their conduct as has been stated in the said order. However, considering the fact that the husband of the informant has been granted anticipatory bail by this Court in A. B. A. No. 1596 of 2020 consequent to the rejection of the prayer for bail of the petitioner nos. 2 and 3, I am inclined to extend the privilege of anticipatory bail to the petitioner -2-nos. 2 and 3. The petitioner nos.
2 and 3 are, therefore, directed to surrender before the learned court below within a period of four weeks and on their surrender, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ramgarh in connection with Ramgarh Mahila P. S. Case No. 15 of 2018, corresponding to G. R. No. 545 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This application stands disposed off.
