JUSTICE RAMESHWAR VYAS Order 01/05/2020 Heard learned counsel for the petitioner Mr. Vijay Raj Bishnoi as well as Mr. Gourav Singh, learned public prosecutor through Whatsapp Video Call and perused the record. Learned counsel for the petitioner argued that the co-accused Jagdish has been granted bail by the co-ordinate bench of this court on 16. 12. 2019 in SB Criminal Misc Bail application no. 15032/2019. The alleged recovery of contraband was made from co-accused Jagdish. The recovered contraband heroine 40 grams is below commercial quantity.
Having regard to the totality of the facts and circumstances of the case, without commenting on the merits of the case, I deem it just and proper to enlarge the accused petitioner on bail under Section 439 Cr. P. C. (2 of 2) [CRLMB-4199/2020] Accordingly, this bail application filed under Section 439 Cr. P. C. is allowed and it is directed that petitioner Shaitana Ram S/o Shri Punma Ram shall be released on bail in connection with FIR No. 291/2019 of Police Station Bhinmal, District Jalore provided he executes a personal bond in a sum of Rs. 50,000/-with one sound and solvent surety of Rs. 50,000/- to the satisfaction of learned trail court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trail.
