B. Civil Writ Petition No. 13561/2024 titled as Surendra Choudhary vs. Rajasthan Staff Selection Board and Ors.
Learned counsel for the respondents has submitted that relaxation of 5 per cent in qualification marks is provided to the SC/ST category. It is further submitted that the candidate who has [2024:RJ-JP:50294] (3 of 3) [CW-12314/2024] applied in the Sports category belongs to the Scheduled Caste category, whereas the said candidate has obtained higher than minimum qualification marks in the said category. Furthermore, it is submitted that the learned counsel for the petitioners has concealed a vital fact qua horizontal reservation therefore, the plea of petitioners qua relaxation in minimum qualifications marks for the SC/ST category is fallacious and against the principle of horizontal reservation. Heard and considered. Considering the arguments advanced by learned counsel for the parties, upon a perusal of records and taking note of the fact that as on date the lis in question is no more res integra, this Court deems it apposite to dispose of the present petition.
Accordingly, the present petition is disposed of. Pending application(s), if any, stand disposed of. (SAMEER JAIN),J Sudeepak/279-S
