This is an application filed by the appellant seeking condonation of 79 days delay in filing the acquittal appeal against the judgment dated 30. 11. 2022 passed in case titled State (Now UT) of J & K Vs. Shair Ali. 2. Notice in the application was issued on 03. 05. 2023. In response whereas Mr. A R Khan, learned counsel has caused appearance on 08. 11. 2024 and was granted four weeks’ time to file objections. He has neither caused appearance nor has filed objections. It seems that he is not opposed to the delay so occurred in filing the appeal.
Otherwise also, the cause shown by the appellant for filing the belated leave application is sufficient which warrants condonation of delay. 3. For the reasons stated in the application coupled with the submissions made at Bar and no objection from the other side, the 2 Crl LP (D) No. 25/2023 CrlM No. 721/2023 application is allowed and the delay of 79 days in filing the acquittal appeal is, accordingly, condoned. 4. Application disposed of.
