Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged. There is alleged recovery of 7 Tins (15 kg. each) filled with refined oil and pasted with forged wrappers of Gagan Active Soyabean Refined Oil Company; 40 empty Tins (15 kg.

each) pasted with forged wrapper of the said Company; and 1508 pieces of forged wrappers of Gagan Active Soyabean Refined Oil from the house of the petitioner. It is further alleged that the petitioner was not authorized to use the name of Bunge Gagan Active Refined Soyabean Oil with respect to manufacturing, packaging, re-labling, whole-selling and distributing and, therefore, he misused the wrapper of the said Company and also caused damage to its business reputation. In fact, no such article/goods has been recovered from the house of the petitioner. The petitioner is a private tutor and has no concern with the alleged offence. He has no criminal antecedent, as has been stated in paragraph no. 11 of the present anticipatory bail application. Having heard learned counsel for the petitioner and considering the materials available on record, this Court is inclined to enlarge the petitioner, above named, on anticipatory bail.
