SIDDHARTH MRIDUL ORDER 02. 08. 2024 Mr. Gautam Nongthombam, learned counsel appears on behalf of the petitioner and Mr. S. Yaiskul, learned counsel appears on behalf of the respondent. The present transfer petition has been instituted on behalf of Mrs. Kapuichuiliu Panmei, the estranged wife of Mr. Indaguang Samrow Panmei, the sole respondent, praying as follows : “In the light of the above few facts and circumstances, it is therefore earnestly prayed that Your Lordship be pleased to grant the following reliefs : a. Transfer the Matrimonial (Divorce) Case No. 3 of 2023 and the Matrimonial (Custody) Case No. 1 of 2024 along with all other connected misc.
cases presently before the Hon’ble Family Court, Tamenglong, Manipur to the Family Court, Imphal East, Manipur; b. pass any order(s) which the Hon’ble Court deems fit and proper for the ends of justice. ” P a g e | 2 The transfer of the aforementioned proceedings has been sought by the wife in view of the extreme difficulty occasioned to the parties in travelling to Tamenglong district due to the current law and order situation in the State of Manipur. It is observed that the petitioner is presently residing at a rented nd accommodation located at Dag No. 339/829, 2 Floor, Nagaram Village, Block-D, Stadium Road, P. O & P. S. Porompat, Imphal East District, Manipur – 795010 within the jurisdiction of the Family Court, Imphal East, Manipur. It is further noted that the respondent is currently posted at SHQ SSB Muzaffarpur, P. O. Umanagar & P. S. Ahiyapur, District Muzaffarpur-842004, Bihar.
In view of the foregoing, learned counsel appearing on behalf of the parties, on instruction, state that it would be appropriate to transfer the aforementioned proceedings pending interse from the Hon’ble Family Court, Tamenglong, Manipur to the Family Court, Imphal East, Manipur. In view of the foregoing and in the interest of justice, it is considered just and fair to transfer Matrimonial (Divorce) Case No. 3 of 2023 and the Matrimonial (Custody) Case No. 1 of 2024 along with all other connected misc. cases pending between the parties from the Family Court, Tamenglong, Manipur to the Family Court, Imphal East, Manipur forthwith. Copy of this order be sent to the concerned Family Court forthwith for information and compliance. With the above direction, the transfer petition is allowed and disposed of.
