IN THE HIGH COURT OF GUJARAT AT AHMEDABAD R/CRIMINAL MISC. APPLICATION NO. 17951 of 2020 ================================================================ MAHAVIR @ HUKUM PRAKASHBHAI HANSORA Versus STATE OF GUJARAT ================================================================ Appearance: MR HEMANT MAKWANA(3622) for the Applicant(s) No. 1 JITENDRAKUMAR S KOTAI(8608) for the Respondent(s) No. 1 MR. H. K. PATEL, APP, (2) for the Respondent(s) No. 1 ================================================================ CORAM: HONOURABLE MR. JUSTICE A. Y. KOGJE Date : 16/12/2020 ORAL ORDER 1. The present application is filed under Section 439 of the Code of Criminal Procedure, 1973, for regular bail in connection with FIR being I-CR No. 93 of 2019 registered with Chandkheda Police Station, Gandhinagar for offence under Sections 395, 397 and 114 of the Indian Penal Code read with Section 135 of the Bombay Police Act. 2.

Learned Advocate appearing on behalf of the applicant submits that considering the nature of the offence, the applicant may be enlarged on regular bail by imposing suitable conditions. 3. Learned APP appearing on behalf of the respondent- State has opposed grant of regular bail looking to the nature and gravity of the offence. Learned Advocates appearing on behalf of the respective parties do not press for further reasoned order. I have heard the learned advocates appearing on the respective parties and perused the papers. Following aspects are considered:- I. The FIR is registered on 28. 04. 2019 for the offence which is alleged to have taken place on 28. 04. 2019. II. The applicant is in jail since 31. 07. 2019. III. The investigation is completed and charge-sheet is filed. IV. Submission of learned advocate for the applicant is that the co-accused, who are identically situated and also having antecedents, have been considered by this Hon'ble Court and enlarged on bail. V.

Submission of learned advocate for the applicant is that the applicant and the original complainant have now amicably settled the matter. He draws attention of this Court to page Nos. 39 and 42 which is the afÏdavit of the original complainant. VI. Learned advocate Mr. J. S. Kotai confirms the contents of the afÏdavit of settlement. VII. Learned APP under instructions of IO is unable to bring on record any special circumstances against the applicant. In the facts and circumstances of the case and considering the nature of the allegations made against the applicant in the FIR, without discussing the evidence in detail, prima facie, this Court is of the opinion that this is a fit case to exercise the discretion and enlarge the applicant on regular bail. 7. Hence, the present application is allowed. The applicant is ordered to be released on regular bail in connection with FIR being I-CR No.
