V/s State of J&K ..... Respondent(s) Through :- Mr. Aseem Sawhney, AAG. Coram: HON’BLE MR. JUSTICE SANJAY DHAR, JUDGE ORDER Vide order dated 19. 06. 2018, the petitioner was granted interim bail. A perusal of the record shows that prior, the petitioner had been granted interim bail by the Court of learned Principal Sessions Judge, Jammu vide its order dated 13. 10. 2017 and later on, it was withdrawn vide order dated 02. 06. 2018. Learned counsel for the petitioner has submitted that co-accused in the case namely Amir Hussain and Shahid Rashid have already been admitted to bail by this Court vide order dated 07. 06. 2018 passed in bail application bearing BA No. 229/2017 and BA No. 230/2017.
Be that as it may, the respondents have not filed objections to the bail application nor anything has been brought before this Court to suggest that the petitioner has misused the concession of bail. Accordingly, the interim bail granted to the petitioner by this Court in terms of order dated 19. 06. 2018 is made absolute. The respondents, 2 BA No. 85/2018 shall, however, be at liberty to seek cancellation of bail of the petitioner before the trail Court in case the petitioner misuses the concession of bail.
