[2026:RJ-JP:37990] HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S. B. Civil Writ Petition No. 14951/2026 CNR: RJHC010685822026 | URN: CW / 27136U / 2026 Shiv Ram Dendor S/o Shri Ramlal Dendor, Aged About 35 Years, R/o Ward No. 09, Rana Ka Vata, Vikas Nagar, District Dungarpur (Raj. ) ----Petitioner Versus Board Of Revenue, Rajasthan, Ajmer. Through Its Registrar. ----Respondent For Petitioner(s) : Mr. Naresh Singh for Mr. Rakesh Arora For Respondent(s) : Mr. S. R. Paliwal, GC HON'BLE MR. JUSTICE YOGENDRA KUMAR PUROHIT Order 10/08/2026 1. The petitioner has preferred the instant writ petition with the following reliefs :- "It is, therefore, most respectfully prayed that this writ petition may kindly be allowed with costs and by issuing an appropriate writ, order or direction the impugned order dated 10. 07. 2026 (Annex. 3) qua the petitioner may be quashed and set aside, as if the same was never passed. Any other order favourable to the petitioner may also be passed. " 2.
Learned counsel for the petitioner at the outset submits that the issue involved in the present writ petition is squarely covered by the order dated 12. 08. 2025 passed in the case of Bhupesh Doda Vs. State of Rajasthan & Ors. (SBCWP No. 15339/2025), wherein a co-ordinate bench of this Court has held that a person appointed in TSP are can only be transferred [2026:RJ-JP:37990] (2 of 3) [CW-14951/2026] within a TSP area and not outside TSP area. The relevant part of the order dated 12. 08. 2025 is reproduced hereunder:- “4. From a close reading of the above rule it is clear that a person appointed in a TSP area can only be transferred within a TSP Area and not outside a TSP Area. 5. The impugned transfer order shows that the petitioner was transferred from TSP Area to Non-TSP Area. Though other grounds have been raised, this Court is not inclined to go into such grounds.
There is a clear violation of Rule 31 of the Rules of 2014 and the transfer is contrary to the Rules of 2014, therefore, the impugned order is liable to be set aside on this ground at the admission stage itself. 6. In the result, the present writ petition is allowed and the impugned transfer order is set aside qua the petitioner. The respondents authorities are given liberty to pass fresh order in terms of Rule 31 of the Rules of 2014. 7. All pending applications, if any, shall stand disposed of. ” 3. In this view of the matter, learned counsel for the petitioner submits that the petitioner may be permitted to file a representation before the respondents in the light of the aforesaid decision in Bhupesh Doda (supra), which may be directed to be decided expeditiously and till the representation is decided, the petitioner may be provided interim protection. 4.
Learned counsel for the respondents submits that impugned transfer order has been passed in administrative exigency, however, does not object grant of interim protection as prayed by counsel for the petitioner. 5. In light of aforementioned submission, the writ petition is disposed of with a direction to the petitioner to file a representation before the respondents within a period of one week and the respondents are directed to pass appropriate order on the representation of the petitioner within a period of fifteen days [2026:RJ-JP:37990] (3 of 3) [CW-14951/2026] thereafter by a speaking order in the light of decision in Bhupesh Doda (supra). 6. In the meanwhile, impugned order dated 10. 07. 2026 qua the petitioner shall remain stayed till disposal of the representation by the respondents, if the petitioner has not joined at the new place of posting. 7.
It is made clear that in case the petitioner does not file representation within a period of seven days from today, the interim order granted by this Court shall vacate automatically. 8. All pending applications, if any, shall stand disposed of. (YOGENDRA KUMAR PUROHIT),J 31/Rajesh Prajapat
