S R RABHA Advocate for the Respondent : PP, ASSAM BEFORE HONOURABLE MRS. JUSTICE RUMI KUMARI PHUKAN ORDER Date : 13-10-2020 By this second pre-arrest bail application under Section 438 Cr. P. C. , the accused-petitioners, namely, Hakim Ali and Raju Ali have sought for bail in connection with Hajo Police Station Case No.

209/2020, registered under Sections 341 /325 /326 /379 /34 IPC on the ground that on earlier occasion due to unavoidable reasons the counsel could not appeared before the court now they intend to place their submissions. Page No. # 2/2 I have heard the submission of the learned counsel for both the parties. It is to be noted that on earlier occasion, this Court has rejected the bail prayer basing on the materials of the case diary, considering the statement of the victim and the medical report and also extortion of money from the victim, this Court is of the opinion that there cannot be any prejudice to the petitioner, even if, not represented. Present petition is without any new ground and devoid of merit. Considering all entirety of the matter and also the fact that no any new ground has been brought on record, I find no merit in the present petition and accordingly the same is rejected.
