N. Sarma, the learned counsel appearing for the respondents. This is an application made under Section 11(5) of the Arbitration and Conciliation Act, 1996 praying for appointment of an Arbitrator. Notice was issued on 09. 01. 2023 whereafter the respondents have appeared who, as indicted above are represented by Shri Sarma, learned counsel. Both the learned counsel have arrived at a consensus that an Arbitrator be appointed to adjudicate a dispute and have suggested the name of Hon’ble Mr. Justice (Retd. ) B. P. Katakey. After hearing the parties and considering the aforesaid submission, the present petition is disposed of by appointing Hon’ble Mr. Justice (Retd. ) B. P. Katakey to act as an Arbitrator to adjudicate the dispute in accordance with law. The parties may approach the learned Arbitrator within a period of 2 (two) weeks from today whereafter the learned Arbitrator would take charge of the matter. Petition stands disposed of.
